(3) accepts responsibility to Bidders for acts or omissions (whether negligent or otherwise) by B/H & Co. (2) gives any warranty to Bidders and any implied warranties & conditions are excluded, (save as so far as such obligations cannot be excluded by Canadian law). nor the Seller (1) is liable for any errors or omissions in any oral or written information provided to Bidders by B/H & Co., whether negligent or otherwise. Exclusions & limitations of liability to Buyers (a) Neither B/H & Co. Examination of Lots (a) B/H & Co s knowledge of lots is partly dependent on information provided by the Seller, & B/H & Co. The Buyer s Premium, Expenses & Hammer Price are subject to G.S.T.
Purchase Price is the hammer price plus applicable Buyer s Premium & Buyer s Expenses. Hammer Price is the highest bid for the Property accepted by the Auctioneer at the Auction, or the post auction sale price. from the Buyer (Shipping, moving, storage, etc.) Buyer s Premium is the commission paid by the Buyer on the hammer price at the rate designated at that Auction Sale. Red Deer, AB., Buyer s Expenses are any costs or expenses due to B/H Co. Seller is the person offering a lot for sale, including their agent, or executors. Buyer is the person who makes the highest bid accepted by the Auctioneer. Definitions Bidder is any person making, attempting or considering making a bid, including Buyers. The Auction Company may occasionally own, or have a financial interest in a lot, eg Cartage, Advance payment, etc. Introduction The Conditions of Sale may be amended by any additional notices posted or announced by the Auctioneer at any particular Sale.
